JURISTAS COBRAM PARECER DA OAB-AM, REFERENTE AO PROTOCOLO ENVIADO AO CFOAB SOBRE MEDIDAS DO STF
Os juristas Paulo Maffioletti e Lúcia Erika de Oliveira solicitaram um parecer, por meio de encaminhamento enviado à OAB-AM – Seccional Amazonas sobre o documento oficiado e feito junto aos demais presidentes de nove seccionais ao Presidente do Conselho Federal da Ordem dos Advogados do Brasil (CFOAB), José Alberto Simonetti, em que cobram providências no que diz respeito às medidas adotadas pelo ministro da Suprema Corte e presidente do Tribunal Superior Eleitoral (STF), Alexandre de Moraes.
O documento destaca sobre “as medidas inconstitucionais de cunho autoritário-inquisitorial implantadas no Brasil como um “regime de terror e lawfare” instaurado em inquéritos inconstitucionais popularmente conhecidos como Inquéritos do Fim do Mundo que tramitam no STF manejado como mecanismo de perseguição e opressão judicial com viés político, partidário e ideológico contra não poucos advogados, políticos, parlamentares, jornalistas, sites de notícias, empresas de comunicação, canais de YouTube, influenciadores e ativistas com a imposição de medidas antidemocráticas e inconstitucionais que ensejaram prisões ilegais e arbitrárias”.
Outro trecho do encaminhamento frisa sobre o que considera “inovação na lei”, e exemplifica com “flagrante eterno”, busca e apreensão, bloqueio de contas bancárias e outras medidas cautelares absurdas de ofício sem a oitiva do Ministério Público como fiscal da ordem jurídico, desmonetização, abolição de perfis de redes sociais em geral e ameaças de encerramento de grupos de mensagens (Telegram), operações polícias realizadas com base em prints de conversas privadas de whatsapp entre cidadãos brasileiros vazadas em site de notícias visando intimidar empresários e outros brasileiros sem foro por prerrogativa de função por crime de opinião”.
Além disso, o documento sintetiza que as medidas aplicadas Alexandre de Moraes causam “gravíssima instabilidade constitucional e democrática no seio da sociedade brasileira configurando uma insegurança jurídica sem precedentes e tirania judicialesca persecutória que pode contaminar integrantes em outras instâncias do Poder Judiciário, a pacificação será uma realidade quando a firme defesa da advocacia e do povo brasileiro for concreta com a aplicação firme da lei contra o autor de tantos atos inconstitucionais, ilegais e arbitrários”.
Ofício enviando ao CFOAB
Os presidentes de dez seccionais da Ordem dos Advogados do Brasil (OAB) se uniram para cobrar do Conselho Federal da OAB um parecer sobre a decisão do ministro Alexandre de Moraes, do Supremo Tribunal Federal (STF), que bloqueou contas bancárias de pessoas físicas e empresas com a justificativa de impedir o financiamento de possíveis atos antidemocráticos.
Um ofício foi enviado ao presidente da OAB, Betto Simonetti, a quem caberá dar ou não encaminhamento ao pedido.
Pedidos semelhantes já haviam sido enviados ao Conselho Federal pelos presidentes da OAB em Mato Grosso e em Mato Grosso do Sul.
As seccionais alegam que receberam reclamações de advogados, que acusam Moraes de dificultar o acesso aos volumes do processo. Além disso, as consultas eram limitadas.
